Cleard Systems LLC (Identification Number: 405258661; hereinafter referred to as “PAYZE” or “We”) is the Payment Service Provider licensed by the National Bank of Georgia (registration number: 0079-2904).
2. Introduction
The foregoing Privacy Policy (hereinafter referred to as the “Policy”) governs matters concerning the processing and storage of personal information and applies to PAYZE customers/merchants, state or local government entities, job seekers, payment system providers, and other persons with whom PAYZE does not have a framework agreement regulating personal data processing issues separately.
We may periodically make changes to the Policy. The updated Policy with the change date will be published on our website: www.payze.io.
3. What Data We Collect About You?
We may collect, use, store and transfer different kinds of personal data about you, including, without limitation, all personal data provided by you such as:
- Identification data – name, surname, gender, date of birth, place of birth, personal number, IP address;
- Contact information – address, phone number; e-mail address, etc.;
- PAYZE product(s)/service(s) you use – one-time payment, subscription payment, etc.;
- Information about your transaction(s)/operation(s) – card operation, settlement operation, refund operation, etc.;
- Documentary data – contracts, identification documents, etc.;
- Technical information – data about your location, information about the devices and technology you use, cookies;
- Special types of data (including biometric data);
- Other information – employment status, etc., as well as the information you provide us through various means of communication, including information on related parties.

PAYZE employs the Cookies technology. Cookies are small textual files that get sent down to your PC or other device that you use to visit the website. Cookies remain on your device and get sent back to the website they came from when you go there again.

- When you register for our online service(s);
- When you apply for our product(s) and service(s);
- During a telephone conversation or your visit at our office;
- When you use our website(s), mobile device app(s) and web chat;
- When you send letters by mail or e-mail;
- When you interact with us in other ways.
We might also collect/obtain your personal data from organizations such as public registers, banks, other financial institutions, and public organizations.
6. What do We Use Personal Information For
PAYZE and other companies within the PAYZE Group may process your personal data or those of third parties indicated by you for a variety of other purposes, including, but not limited to:
- Managing our relationship with you;
- Delivering our product(s) and service(s) efficiently and properly;
- Meeting your needs, developing new ways of cooperation and growing our business;
- Developing and implementing marketing activities, such as periodic offers of various product(s)/service(s) by PAYZE;
- Preparing and presenting various reports, studies and/or presentations;
- Studying how customers use our product(s) and service(s);
- Conducting various studies aimed at improving products and services;
- Receiving advice or recommendations regarding our product(s) and service(s);
- Developing/Managing our brands, product(s) and service(s);
- Offering new and/or additional product(s), desired and/or necessary prerequisite of which is the verification of the data subject's transactional history and/or behavioral characteristics at the time of the offer;
- Detecting, investigating, reporting and preventing financial crime(s) (i.e. to ensure security, as well as to detect and/or prevent fraud, money laundering, or other crimes);
- Managing our and our customers' risks;
- Responding to complaints/claims and finding ways to resolve them;
- Protecting the legitimate interests of PAYZE;
- In cases established by law, ensuring availability of data to auditors, regulatory, controlling or other supervisory authorities;

- Complying with the requirements established by applicable legislation.
If the data subject's consent is required by the applicable law(s), any application made in electronic and/or non-electronic form by which you agree to this Policy will be considered as such consent.
7. Legal Basis for Using/Processing Personal Data
The basis for our using/processing of your data is:
- Legislation related to the provision of payment services;
- Your consent to data usage/processing;
- Need for data processing to fulfill obligations under the contract concluded with you;
- Necessity of data processing to:
- fulfill the obligation(s) defined by applicable law;
- protect your or a third party's legal interests;
- protect our legitimate interests.
8. Disclosures of Personal Data
PAYZE strictly protects the confidentiality of information about you, including personal data, although we are authorized to disclose it to the following third party(ies) or to obtain information about you from the same third party(ies), if: (a) it is necessary to provide the service(s) properly; or (b) it is defined/required under legislation.
Subject to the above, PAYZE may share your data with the following entities:
- Other affiliated companies within PAYZE Group;
- PAYZE's partner companies, including financial institutions with which PAYZE cooperates commercially;
- Supervisory, controlling and/or registration and/or regulatory bodies, state or local self-government authorities and legal entities under them;
- International and local payment service operators;
- Any person acting as our representative, with the assurance of strict confidentiality;
- Any person to whom We may transfer our rights and duties based on the agreement/contract between you and PAYZE;
- Other person(s) as determined by applicable laws.
You hereby acknowledge and agree that the list given above is not exhaustive, and from time to time the number of such persons may increase or decrease, however, PAYZE's actions in terms of data processing will be in accordance with the requirements defined by personal data protection legislation of Georgia.
9. Your Rights
In relation to your personal data, you have the right to:
- Request information about what kind of personal data are being processed about you, including how and for what purpose this data was collected;
- Request information about the third parties or groups of persons to whom your personal data has been transferred;
- Request correction or completion of data if personal data is inaccurate or incomplete;
- Opt out of the processing of your data for advertising or market/opinion research purposes;
- Request termination of processing of your data and/or the deletion/destruction of the processed data, if:
- you withdraw the consent, which is the only basis for data processing;
- data processing is no longer necessary for the purpose for which it was collected;
- data processing is carried out illegally;
- At any time decline the consent by which you have given us the right to process your data. In such case, We will stop the processing, unless there is another basis/obligation under data processing legislation.
In order to provide efficient service(s), it is crucial for us to have complete and correct information about you, therefore, if you believe that the information stored in PAYZE about you is not true, accurate, and/or up to date, you are obligated to immediately notify us in writing to the e-mail address specified in Article 12 of this Policy.
10. Personal Data Security
We have put in place all organizational and technical measures for data protection as prescribed by domestic laws on personal data protection.
We will take all necessary and sufficient organizational and technical measures to protect your information from unauthorized or accidental access, destruction, modification, blocking, copying, sharing, as well as from other illegal actions of third parties.
We are not responsible for the illegal actions or attempts of third parties, hackers, attackers or other violators of this Policy to steal your personal information in whole or in part, to the extent that such actions are beyond our control.
Only our authorized representatives involved in the provision of services have direct access to personal information.
11. How Long We Keep Personal Data
We store your data:
- For the period necessary to achieve the purpose/interest of the processing;
- Within the scope of the terms established by the agreement between PAYZE and you;
- In accordance with the deadlines/periods defined by the legislation of Georgia.

PAYZE can be contacted by e-mail at: [email protected], as well as by live chat on the PAYZE platform (at any time during the following periods: from Monday to Friday from 10:00 to 19:00, except for statutory public holidays).
Notifications shall be considered accepted from the moment of PAYZE's confirmation of receipt of the relevant notification or the implementation of the relevant action.
